Please read these terms and conditions (hereinafter the "Conditions") carefully before using the Portal. By using the Portal, the User accepts the Conditions and undertakes to respect them. Otherwise, the User cannot use the Portal.
The Owner may modify or simply update these Conditions, in whole or in part. Changes and updates will be binding as soon as they are published on the Portal. The User is therefore invited to view the Conditions at each access to the Portal and it is advisable to print a copy for future consultations.
1. registration
In order to use some features of the Portal, Users must register by providing, in a truthful, complete and correct manner, all the data requested in the relevant registration form and fully accept the privacy policy (https://panbrioche.com/informativa- privacy /) and these Terms. The User has the duty to keep their login credentials.
It is understood that in no case can the Data Controller be held responsible in the event of loss, diffusion, theft or unauthorized use by third parties, for any reason whatsoever, of the Users' access credentials.
If the Data Controller, at its sole discretion, deems the veracity of one or more personal data used during the registration of the account to be doubtful or false, it may proceed with the suspension of this without prior notice or verification. This account can only be restored if the user presents himself on his own initiative with documentation certifying the veracity of his personal data within 30 days of the suspension.
2. Account cancellation and closure
The Registered User may stop using the Services at any time, deactivate your account or request its deletion through the Portal interface (by performing the login and accessing the page account), or by contacting the Owner directly at the email address info@panbrioche.com. However the user cannot request a refund of digital purchases to which he has already had access.

2a Renewals and cancellations
The subscription is automatically renewed every year, at the price agreed upon during the subscription phase (therefore the price remains fixed and is not subject to the annual increases that only new subscribers are subject to). If activated with a discount code, this will be valid only for the first year, after which the subscription will be renewed at the full price active at the time of subscription activation.
Any price changes in subsequent renewals will be promptly communicated via email. In this case, it will be up to the User to cancel their subscription if they do not agree with the new terms and conditions.
In all cases, within 10 days and then within 3 days of the automatic renewal of the subscription, the user receives a reminder of the next renewal via email. However, you can cancel the automatic renewal at any time during the subscription period. The reminder is intended as a courtesy on the part of the Owner to avoid unwanted renewals, but the responsibility for prompt cancellation lies entirely with the user.
Due to time zones, the subscription renewal or expiration date indicated on the reminder or registration email may not correspond to that of the country in which you reside. Therefore it is appropriate cancel the automatic renewal at least 24 hours in advance to avoid an unwanted payment.
In case of cancellation request to the assistance service, this must be sent and received within a maximum of 24 hours from the expected deadline, to allow for timely intervention. Likewise, the user is responsible for the imminent renewal of his/her subscription, and as such, if he/she does not wish to renew it, he/she is required to cancel the renewal promptly, i.e. within 24 hours of the renewal date, to avoid any asynchronies due to different time zones (site, user, navigation location).
Refund requests for failure to cancel in a timely manner will not be accepted. of automatic renewal, if the reminder emails have been correctly forwarded by the Portal or if the request for assistance for cancellation has not been made at least 24 hours before the expected automatic renewal.
3. Shopping on panbrioche.com
The purchase of one or more Services through the Portal is allowed both to Users who have the quality of consumers, and to users who do not have this quality.
Pursuant to art. 3, I comma, lett. a) of Legislative Decree 206/2005 ("Consumer Code") we remind you that natural persons who, in relation to the purchase of the Services, act for purposes unrelated to any entrepreneurial, commercial, professional or craft activity carried out.
Individuals are allowed to purchase only on condition that they are at least eighteen years old.
The Owner undertakes to describe and present the Services offered free of charge and / or sold on the Portal in the best possible way. Nevertheless, some errors, inaccuracies or small differences between the Portal and the actual Service may emerge. Furthermore, any photographs of the Products related to the Services on the Portal do not constitute a contractual element, as they are only representative.
The Services, prices and conditions of sale of the Services, within the limits of their availability, they do not constitute an offer to the public; therefore, they must always be considered indicative and subject to express confirmation via e-mail or by viewing the order confirmation page by the Owner, after checking the availability of the chosen Service.
The User expressly attributes to the Holder the right to accept even partially the order placed (for example in the event that there is not the availability of all the Services ordered). In this case, the contract will be considered completed in relation to the Services actually sold. The Owner reserves the right to modify, at any time, the price of the Services and any related extra expenses. It is understood that any changes will in no case affect the contracts already concluded before the change.
The sale prices of the Services are subject to the flat rate regime, therefore exempt from VAT; any other tax and / or shipping costs charged to the User will be indicated before confirming the purchase.
Payment for the Services can be made using the methods indicated on the Portal at the time of purchase.
The portal uses third-party tools for processing payments and does not in any way come into contact with the payment data provided (credit card number, name of the holders, passwords, etc.).
If these third-party tools deny the payment authorization, the Owner will not be able to provide the Services and will not be responsible for any delay or failure to deliver.
3a. Plans and Subscriptions
The main services offered on the Portal are subscriptions aimed at accessing information and training contents for a certain period of time. Each subscription, hereinafter referred to as the Plan, offers specific services and contents and excludes others. These services and contents may be subject to change over time. If the subscribed plan is changed positively (offering more services) or negatively (offering less) the user will remain subscribed unchanged until the natural expiry of the subscription. This must be understood as true even if the subscribed plan is canceled and can no longer be subscribed or renewable. This does not apply to those plans which have been subscribed for free.
To access one of the following individual plans, registration is required which involves sending personal data which must be complete and truthful. In no way do they accept false or incorrect data. It is the responsibility of those who fill out the registration form to verify the correctness of the data entered and their regular updating. In the event of false or incorrect data, the account will be suspended and / or canceled without prior notice and without the obligation of reimbursement by the Owner. Subscription to paid plans requires the mandatory entry of all personal data (full name, address, social security number or VAT number) for billing purposes.

The advertising within the pages and the presence of sections and services accessible to subscribers to higher plans remain in place.
Madre Plan
The Mother Plan is paid, with annual renewal and can be canceled at any time by the user.
The Mother Plan offers access to all the contents of the Biscuit Plan, plus access to technical guides on pasta madre, liquid sourdough and the technology of bread dough and similar products. Also include bread recipes, access to restricted areas of the forum, extra forum features, access to the glossary, and more, specified on the Plan page, which is continually updated.
The subscription does not include consultancy or the obligation to respond to requests for assistance and help on sourdough and dough from the Owner or the Portal's collaborators.

The Panettone Plan is paid, with annual renewal and can be canceled at any time by the user.

The Panettone VIP Plan is paid, with annual renewal, which can be canceled at any time by the user.
The Piano Panettone VIP offers all the contents of the Piano Panettone, plus the Advisory Service on topics such as pasta madre and dough.
The Consultancy service gives you the right to access thereserved area of the Forum called Panettone VIP, the place where requests for advice and the consultations themselves take place. The public nature of the forum (where public means only the set of Users subscribed to the Piano Panettone VIP) allows also access the consultancy services of third parties and benefit from the responses they receive.
The Consulting service guarantees answers and assistance on the topic of pasta madre (solid sourdough starter) and licoli (liquid sourdough starter) and dough of bread and large leavened products, while it may not satisfy needs related to other types of products (pizza, viennoiserie, etc.).
The Consulting service is valid for for the entire duration of the subscription (one year), and it is accessible only via FORUM (no email, no WhastApp, no Telegram etc.).
The consultancy service is guaranteed only in Italian and English. It will be the duty of the user, possibly, to use an automatic translator to communicate in one of these two languages.
In order to guarantee the service to all those who request it and avoid abuse, the consultations will be guaranteed in the following terms:
- Any request for advice must be requested directly inreserved area Panettone VIP;
- Each request for advice corresponds to a new discussion;
- They are guaranteed up to one maximum of 2 threads per month per subscriber;
- Up to a maximum of 3 responses are guaranteed in each discussion / consultation;

– If the request for consultancy concerns a topic not yet covered in the guides and insights of Pan Brioche, can be refused or processed only partially, at the sole discretion of the Owner;
- If the request for advice does not fall within the skills and knowledge of the Owner or of the person required to provide the advice, you will be entitled to further discussion / advice on other issues;
– The User or the Owner can set the discussion as private, and thus make the consultation not visible to other Users;
- Answers to requests for advice and discussions are guaranteed on average within 2 working days (48 hours) from receipt of the messages (Italian time). There may be delays in case of overload of requests, high season (November-January, March-April), holidays or sickness;
- The contents of the Panettone VIP area are subject to a confidentiality agreement between all subscribed Users. In the event of suspected or proven disclosure of such content by a subscriber, the Owner - at its sole discretion - will immediately block access to the area reserved for that subscriber, thus revoking the right to the Consultancy service;
- Any decision by the User not to use the Consultancy service during the subscription period does not give the right to request refunds.

3b. Confidentiality agreement
The User who signs up for any of the above plans undertakes not to share or disclose the contents to which he or she accesses. The user also guarantees not to distribute his access keys to the reserved area of the Portal to other people. The Owner reserves the right to immediately suspend the account if it has reasonable doubts about compliance with this Confidentiality Agreement or if there is evidence of disclosure. The Confidentiality Agreement is considered to be infringed even if a content of the Portal is partially modified (in form and / or content) to be published in third locations.
3c. Upgrade and Downgrade
The User can only be enrolled in one plan at a time. However, you can upgrade to move from a lower tier to a higher tier (in terms of cost). The User will thus have a new subscription start date, and will not pay the difference of the amount not yet consumed of the old subscription.
If the User is inactive, unreachable, with a registration that includes untrue or outdated data, he will automatically be downgraded to the free subscription plan.
3d. Gift subscription
It is possible to purchase a subscription as a gift for a third person by purchasing a coupon of equal value to the subscription you wish to give as a gift. The purchase can be made with different payment methods. Once the payment has been made, the coupon, also known as a discount code, is sent via email to the buyer, who can give it as a gift to anyone he wishes. The subscription, like any other subscription, will be automatically renewable unless canceled by the subscriber.

3e. Languages, services and technical assistance
The original language of the Portal is Italian. All content is optimized for that language.
The English, Spanish, Portuguese and French versions and other languages are the result of automatic translations created by software. Therefore they may sometimes be inaccurate or incorrect. The User, upon subscribing to the site, accepts this possibility.
The technical assistance service, via mail, Chat Live, WhatsApp and Telegram and Forum is provided only in Italian and English.
The advisory service envisaged by the Panettone VIP Plan, is provided only in Italian and English.
In general any type of communication with the Owner is guaranteed in Italian and English only.
4. Conclusion of the contract
The Contract stipulated through the Portal is considered concluded when the User receives, via e-mail and / or by viewing a page of the Portal, the formal confirmation of the order through which the Owner accepts the order sent. by the User and informs him that he can proceed with the evasion of the same.
The Contract is concluded in the place where the registered office of the Owner is located.
The Owner reserves the right to refuse an order:
- When the Service is not available;
- When the Owner does not receive the authorization to charge the cost of the Service to the User;
- When at the time of purchase a clearly incorrect and recognizable price is indicated. In this case, the User will be contacted by Customer Service to be informed and will receive a refund relating to the transaction made;
- When the Owner has found an improper use of the previously purchased Services or of the free services available to users registered on the Portal;
- When the Data Controller doubts the veracity of the personal data used during registration and / or purchase.
Until the User has received the confirmation referred to in the previous point, he has the right to proceed with the cancellation of the order by sending an e-mail to the address of the Owner.
5. Billing
The commercial invoice will be issued and sent by the Owner following a specific request from the subscriber in the subscription phase. The User is required to provide the data required for billing, such as full name, street address and tax code, VAT number and SDI code if available. For the issuing of the invoice, the information provided by the User in his user profile will be valid, which he declares and guarantees to be truthful, granting the Owner all the most extensive indemnity in this regard.
No invoices will be issued to anyone requesting them more than 12 calendar days after payment.
6. Delivery methods
The Owner will deliver the Service to the User within a maximum of 2 working days from the purchase. The Service will be made accessible through a specific link, sent by e-mail and / or published in the User Area.
Upon receipt, the User is required to verify the conformity of the Service delivered to him with the order placed. In case of non-compliance or anomalies (such as inability to access), he is required to report it immediately.
7. Right of withdrawal of digital products and / or services
As required by Article 59 of the Consumer Code the right of withdrawal is excluded for digital products.

8. Industrial and Intellectual Property Rights

These Conditions do not grant the User any license to use the Portal and/or individual contents and/or materials available therein. 9. Disclaimer of Warranty
The Portal is provided "as is" and "as it is available" and the Owner does not provide any explicit or implicit guarantee in relation to the Portal, nor does it provide any guarantee that the Portal will meet the needs of Users or that it will never have interruptions or it will be error free or virus or bug free.
The Owner will endeavor to ensure that the Portal is available continuously 24 hours a day, but cannot in any way be held responsible if, for any reason, the Portal is not accessible and / or operational at any time or for any period. Access to the Portal may be suspended temporarily and without notice in the event of system failure, maintenance, repairs or for reasons completely unrelated to the will of the Owner or for events of force majeure.
The Owner - as the only responsible and operational person behind the Portal - will always do everything possible to respond in a timely manner to reports of malfunctions, anomalies, shortcomings and technical problems of any kind, it being understood that it does not guarantee availability in the evening, weekend and public holidays and pre-holidays. The Data Controller may also not fulfill the assistance service during holidays or sickness.
10. Limitation of Liability
The User undertakes to indemnify and hold harmless the Data Controller (as well as any companies controlled or affiliated by the same, its representatives, collaborators, consultants, administrators, agents, licensees, partners and employees), from any obligation or liability, including any legal costs incurred to defend oneself in court, which should arise in the face of damages caused to other Users or third parties, in relation to the Content uploaded, to the violation of the terms of the law or the terms of these Conditions.
Therefore, the Data Controller will not be responsible for:
1. Any losses that are not a direct consequence of the breach of the Contract by the Owner;
2. Any loss of commercial opportunity and any other loss, even indirect, possibly suffered by the User (such as, but not limited to, commercial losses, loss of revenues, revenues, profits or presumed savings, loss of contracts or relationships commercial, loss of reputation or goodwill, etc.);
3. Damages or losses deriving from interruptions or malfunctions of the Portal due to events of force majeure or, in any case, to unforeseen and unforeseeable events and, in any case, independent of the will and outside the control of the Data Controller such as, by way of example and not exhaustive , breakdowns or interruptions to telephone or electrical lines, to the internet and / or in any case to other transmission tools, unavailability of websites, strikes, natural events, viruses and computer attacks, interruptions in the supply of third-party products, services or applications set off;
4. Incorrect or unsuitable use of the Portal by Users or third parties;
5. The issuance of incorrect tax documents due to errors relating to the data provided by the user, the latter being solely responsible for the correct insertion.
In no case may the owner's liability limit be greater than double the cost paid by the user for the service used.
11. Link to third party sites
The Portal may contain links to third party sites. The Owner does not exercise any control over them and, therefore, is in no way responsible for the contents of these sites.
Some of these links may refer to third party sites that provide services through the Portal. In these cases, the general conditions for the use of the site and for the use of the service prepared by third parties will apply to the individual services, with respect to which the Data Controller assumes no responsibility.
12. Major force
The Data Controller cannot be held responsible for the failure or delayed fulfillment of its obligations hereunder, due to circumstances beyond the reasonable and foreseeable control of the Data Controller. The fulfillment of the obligations by the Owner pursuant to these Conditions will be considered suspended for the period in which the Force Majeure Events occur. The Data Controller will carry out any act in its power in order to identify solutions that allow the correct fulfillment of its obligations despite the persistence of Force Majeure Events.
13. Waiver
No waiver by either party of an article of these Terms will be effective unless it is expressly stated to be a waiver and is communicated in writing.
14. Invalidity of individual clauses
If any provision of these Conditions is illegal or invalid, it will not be considered as part of the General Conditions and this will not affect the remaining provisions which will continue to be valid to the fullest extent permitted by law.
15. Modification
The Owner reserves the right to modify these Conditions at any time by giving specific notice on the Portal and / or via email. The User acknowledges and accepts that any changes to these Conditions will apply to orders sent by Users after the date of communication of the modification of the Conditions.
16. Privacy

17. Applicable law and competent court
These Conditions and all disputes regarding the execution, interpretation and validity of this contract are subject to Italian law and to the exclusive jurisdiction of the court of the place where the Data Controller is based.
If the User is a consumer pursuant to Article 3 of the Consumer Code, the mandatory territorial jurisdiction is of the judge of the place of residence or domicile of the consumer himself, if located in the territory of the Italian State, without prejudice to the right for the user -consumer to appeal to a judge other than that of the "consumer forum" pursuant to art. 66 bis of the Consumer Code, competent for the territory according to one of the criteria referred to in Articles. 18, 19 and 20 of the civil procedure code.
18. Online dispute resolution for consumers
The consumer resident in Europe must be aware of the fact that the European Commission has set up an online platform that provides an alternative dispute resolution tool.
